Over 400 arbitrators who issued awards for large, complex commercial cases were surveyed about the various elements of those cases, from motion practice and discovery to cooperation among participants. Findings might surprise the parties and their attorneys!

Results present hard data that the way counsel and parties handle their cases—and themselves—can negatively affect the efficiency and cost-effectiveness of the case. Conversely, however, if parties and attorneys address these items, they could increase the cost-effectiveness of their cases.

Arbitrators surveyed served on commercial cases with at least $1 million in claims or counterclaims. The median claim was $2,478,540.

Specifically recorded are arbitrators’ views on:

  • Factors that contribute most to case escalation.
  • The use of motion practice and discovery.
  • Best practices to improve the economy and efficiency of an arbitration.
