Helping tenants and landlords with repayment issues

Recent business closures and other measures ordered by federal, state, and local governments throughout the country to help slow the spread of COVID-19 has greatly limited the ability for many people to earn income, resulting in an inability to afford their rent payments.

Because of this, numerous states and municipalities have issued executive orders requiring a moratorium on commercial and residential evictions for tenants who are able to show an inability to pay rent due to circumstances related to the COVID-19 pandemic. The moratoria typically last 60-90 days and vary in terms. Essentially, they restrict evictions due to loss of income from:

A COVID-19 related workplace closure;
Childcare expenditures due to school or day care closures;
Health-care expenses related to illness with COVID-19, either personally or caring for a member of the tenant’s household who is ill with COVID-19; and/or
Reasonable expenditures that stem from government-ordered emergency measures.

Unfortunately, future disputes might develop, as these executive orders typically are silent as to how landlords and tenants establish repayment terms once the moratorium lapses.

Our preparedness plan

Business Continuity. We have previously incorporated business continuity planning into our operations, and we have updated that planning on a continuing basis so that we can continue our work as seamlessly as possible under circumstances such as the spread of COVID-19.

Focus on security. We have implemented best practices, technologies and procedures to help protect data and technology resources. The protections implements apply to all case data and equipment stored and managed on the AAA-ICDR’s vast technology infrastructure.

Uninterrupted Service. We have planning that provides for backup servers and redundancies, and security on our IT, case filing and management, and finance operations.
