The American Arbitration Association® Seeks Public Comment on Draft Amendments to the Consumer Arbitration Rules and Employment Arbitration Rules.

The AAA has drafted proposed revisions to its Consumer Arbitration Rules and its Employment Arbitration Rules to modernize and clarify them.

The proposed amendments were drafted with the following principles in mind:

  • Transparency: Rules must provide clear information about the process and the responsibilities of all parties.
  • Fairness: Rules must reflect the Consumer Due Process Protocol and the Employment Due Process Protocol and promote neutrality in arbitrator selection.
  • Efficiency and Accessibility: Rules should streamline processes to reduce time and costs.
  • Ethics and Conduct: Rules must incorporate guidelines for the conduct expected of parties and their representatives.

Our proposed changes reflect these goals. We have also reordered some rules for a more logical flow within the rule sets.

We look forward to receiving all stakeholders' comments and feedback from this public review and comment process. Both rule sets and guidance documents comparing the proposed revised rules to the current ones are linked below.
